Terms and Conditions

I. Scope and Acceptance of the GTC

• These GTC become effective upon the User’s acceptance, which occurs electronically during registration or use of the Application.
• Users cannot access or use the Application without accepting these GTC.
• Provider may amend these GTC at any time. Users will be notified of significant changes. Continued use of the Application after changes implies acceptance of the updated GTC.
• If a User does not accept the amended GTC, their account may be deleted, and access to services terminated.

II. General Conditions

• Provider retains all rights to the Application, its design, content, and all intellectual property displayed therein.
• All guidelines, policies, and documents linked to these GTC are part of the GTC and binding on Users.
• Provider may record customer communications (e.g. calls, emails) for quality or complaint handling purposes, with prior notice.
• Users may terminate their account via the Application interface.
• Users who consent to marketing communications may receive updates, news, and offers from the Provider or partners. Users may unsubscribe at any time.
• System messages related to technical operation or essential service updates are not considered marketing and cannot be unsubscribed from while the account exists.

III. Registration and Account

• Use of the Application requires registration.
• Registration may be conducted via third-party accounts (e.g. Apple, Google, social media accounts).
• Provider processes personal data in accordance with its Privacy Policy.
• Users must be at least 16 years old to register independently. Users under 16 require parental or legal guardian consent.
• Provider confirms successful registration via email. Provider does not store third-party platform passwords.
• By registering, Users consent to share technical data such as IP address and country location with Provider.
• Users agree to receive service-related communications from Provider and partners upon accepting the GTC and Privacy Policy.

IV. Use of Services

• Users may use the Application to upload and share content such as photos, videos, or messages, which may appear on:
  • Waveplus platforms
  • Partner websites
  • Public displays at events
• Users select specific events or channels for their content submissions.
• Users can preview, retake, or approve photos or videos before uploading.
• By clicking “Share,” Users consent to the public display and sharing of their uploaded content, as described in these GTC.
• Uploaded content is subject to review by the Provider and may be refused for publication based on content policies (see Section V).
• Paid features may be available in the Application. Details, pricing, and payment terms are described in the Application interface.

V. Prohibited Content

• Vulgar, obscene, or offensive material
• Content promoting violence, hate, or discrimination
• Illegal substances or dangerous items
• Pornographic or sexually explicit content
• Content infringing third-party intellectual property rights
• Any content violating applicable laws
• Content that Provider deems inappropriate for legitimate business reasons

Provider reserves the right to refuse or remove content at its discretion, even if it does not explicitly fall under the categories above. Users are solely responsible for legal consequences arising from prohibited content.

VI. Intellectual Property Rights

• The Application, design, logos, and all related materials are the exclusive intellectual property of Provider.
• Users may not duplicate, modify, distribute, or commercially exploit any part of the Application without Provider’s written consent.
• Users grant Provider and partners an irrevocable, worldwide, royalty-free license to use uploaded content for display, publication, reproduction, and marketing.

VII. Responsibility and Liability

• Provider strives to keep the Application available and functioning but does not guarantee uninterrupted or error-free operation.
• Provider is not liable for damages caused by user errors, technical issues beyond its control, or force majeure events.
• Users accept that using the Application is at their own risk.
• Provider may modify or suspend parts of the Application at any time.

VIII. Account Restrictions and Termination

• Provider may suspend or terminate User accounts in cases of GTC violations, prohibited content, misuse, or legal obligations.

Provider will acknowledge and respond to complaints within 30 days. Belgian law applies, and disputes may be brought before Belgian or EU dispute resolution bodies.

X. Miscellaneous

• Users consent to receive software updates aimed at improving functionality or security.
• Belgian law governs these GTC.
• If any provision is invalid, the rest remains effective.
• The English version of these GTC prevails in case of inconsistencies.
